Using the Platform with Confidential Information
Prepared 7 September 2026
Guidance
Is it appropriate to input confidential information?
Yes, subject to the conditions below. The standard that applies to a lawyer or investor using a third-party tool is one of reasonable diligence and reasonable safeguards, not a specific certification. On that standard, Crossband.io rests on three documented pillars:
- No training, by contract. Both AI providers are contractually barred from training on your inputs or outputs, and data is retained only briefly for abuse monitoring — see LLM Use And Confidentiality.
- A supportive legal environment. The emerging case law penalises consumer AI tools whose terms permit training and protects enterprise / API deployments governed by contract — the configuration Crossband.io uses. See LLM Confidentiality Environment.
- Reasonable platform controls. Authenticated access, encryption, and certified cloud infrastructure — see Platform Security & Controls.
Responsibilities
Your responsibilities as a user
Regardless of the platform's posture, the decision to input a particular document remains yours. Before submitting confidential information, confirm that:
- You are authorised to input it — for example, you own it, or your engagement or an applicable agreement permits you to process it using third-party service providers.
- No specific obligation prohibits third-party or AI processing of that particular information (some non-disclosure agreements restrict disclosure to any third party, including subprocessors).
- Where required, you have obtained any necessary consent (for example, client consent for privileged or personal information).
Where an agreement is silent or ambiguous, the cleanest way to remove doubt is to make the permission explicit — which is what the sample language below is for.
Templates
Suggested language for your confidentiality agreements
The clauses below are drafting starting points a receiving party can include in a non-disclosure or confidentiality agreement so that using AI-enabled tools and cloud subprocessors (such as Crossband.io) is clearly permitted. They are illustrative only.
These clauses are templates, not legal advice, and are not tailored to any particular agreement or jurisdiction. They should be reviewed and adapted by qualified counsel before use.
Support
What Crossband.io provides
To support a user’s own diligence, Crossband.io can make available:
- The companion documents: LLM Use And Confidentiality, LLM Confidentiality Environment, and Platform Security & Controls.
- The underlying providers’ SOC 2 / ISO reports (Anthropic and Google Cloud).
Caveats
Important notes
This document is general information about how to use the platform, not legal advice, and does not create any advisory relationship. It should not be relied upon as a substitute for advice from qualified counsel about a specific agreement, obligation, or jurisdiction. The sample clauses are illustrative templates only. The legal landscape for AI and confidentiality is developing; positions should be re-verified against current sources and, where a matter is material, confirmed with a lawyer.
